Apex.AI, Inc. (“Apex.AI”) thanks you for visiting our site and trusting us with your privacy.  We understand your privacy is very important to you and we are committed to living up to the trust you have placed in us by handling your private information with care.  This privacy policy (the “Policy”) describes how Apex.AI collects, uses, and shares the Personal Information, as defined below, of our users who access this website, our social media pages, software applications, email communications, and all other digital services. Such change will be effective ten (10) days following posting of the revised  Policy on this site, and your continued use of this site thereafter means that you accept those changes.

  • Resumes, CVs, personal references, and other employee candidate data you submit when you apply for a position at Apex.AI;

  • Communications and other feedback, including questions, software bug reports, and other messages you address to us directly through email, slack, GitLab, or other online forums; and

  • Any information disclosed when engaging with us on social media;

 

Please note: If you submit any information relating to people other than yourself, by submitting that information you are representing that you are authorized to provide us with such information and you consent to the use of the information in accordance with this Policy.

4. Apex.AI Uses Your Information in the Following Ways: 

  • To Further an Established Business Relationship. We may use collected information to configure orders or contact you as necessary to fulfill orders you have placed for Apex.AI products, services, or events. We may also contact you to ask for your feedback about a product, service, or event.

  • To Send You Promotional Materials. We may also use your information to fulfill your requests, including, but not limited to, requests to receive promotional materials. Promotional materials may include information regarding Apex.AI events, products, or services. We may also use your information to share other services or products that may be of interest to you. Promotional materials may be conveyed in emails. If you no longer wish to receive these materials, you may opt-out by following the opt-out instructions included in our emails or by contacting us at the address below.

  • To Improve Our Services. As described above, we may collect information using Cookies, tracking tools, and/or analytic tools. We may use this information to personalize your experience on this site and to improve the security, design, and/or function of this site.

  • To provide You With Customer Support.  We may use your Personal Information to complete and fulfill your purchased licenses, services, or other transactions, including processing your payments, communicate with you regarding your order, or provide you with relevant updates on our products or services, and provide you with related customer support.   • To Comply With Legal Obligations.   • To Ensure our Affiliates Can Provide Services to You. We may send or otherwise share your Personal Information to our affiliated entities for the purpose of storing such information on our behalf, or for other processing needs. These affiliated entities may be based in other countries, and their servers may be located anywhere in the world. We require these affiliated entities to agree to process such Personal Information in accordance with this Policy.

  • To comply with due diligence requests during a financial transaction.  We may share Personal Information when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction, or proceeding.

  • To comply with the law or a legal obligation. 6. Sale of your data.  

Apex.AI does not sell your data to anyone for any purpose.

 

7. Minors and Children's Online Privacy Protection Act

No part of this site is structured to attract, nor is the site directed toward children under the age of 13 years. We do not intend to collect Personal Information from anyone we know to be under the age of 13 years. If we learn that we have collected Personal Information from a child under the age of 13 years, we will use commercially reasonable efforts to delete that information. 8. California Do Not Track Disclosure

Do Not Track (“DNT”) is a privacy preference that you can set in your web browsers, which allows you to opt-out of tracking by websites and online services. We do not currently recognize or respond to DNT signals.


9. Notice to California Residents / Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (“CCPA”) provides you with certain rights. Including the right to request:

  • The categories of Personal Information we collect and our business purpose for collecting your Personal Information. 

  • Provide you a copy of certain Personal Information of yours that we possess.

  • The deletion of certain Personal Information of yours that we possess.

Please note:  certain information may be exempt from such requests under California law.  For example, we are not able to provide our website to you without receiving certain information from you.  

  • Verification: Depending on the sensitivity and the type of request you are making, we will take reasonable steps to verify your identity based on the information that we currently possess. 

  • Authorized Agent: You are permitted to designate an authorized agent to submit certain requests on your behalf.  In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. 

The CCPA also provides you with the right not to be discriminated against (as provided for by applicable law) for exercising your access or deletion rights.

9.1 California “Shine the Light” Disclosure

If you are a California resident, you have the right to request information from Apex.AI regarding the manner in which Apex.AI  shares certain categories of your Personal Information with third-parties, for the third-parties’ direct marketing purposes.  We do not share Personal Information for such purposes.

 

9.2 Deletion of Certain Content Created By California Residents. 

If you are a California resident under the age of 18 and a registered user, California law may permit you to remove content or Personal Information you have publicly posted. If you wish to remove such content or Personal Information and you specify which content or Personal Information you wish to be removed, we will do so in accordance with applicable law. Please be aware that after removal you will not be able to restore removed content. In addition, such removal does not ensure complete or comprehensive removal of the content or Personal Information you have posted and that there may be circumstances in which the law does not require us to enable removal of content.

Apex.AI has implemented various physical, electronic, contractual, and managerial security measures to protect against loss, misuse, and alteration of Personal Information that we store and collect. However, no method of transmission over the Internet, and no means of electronic or physical storage, is absolutely secure. If you opt-out, we may still contact you regarding certain non-marketing subjects. Please allow a reasonable time after reaching out for us to process your request.

  • You may send all other requests about Personal Information to the addresses set out below. You can request to change contact choices, opt-out of our sharing with others, update your Personal Information, or cancel an account if one has been created.

  • You can typically remove and reject cookies from our site with your browser settings. Many browsers are set to accept cookies until you change your settings. If you remove or reject our cookies, it could affect how our site works for you.
     

12. Access to your Data; Ensuring Your Data’s Accuracy. 

We would like to maintain accurate Personal Information. If you would like to delete or correct any of your Personal Information that we may be storing, there may be tools that we make available via this site. Otherwise, please contact us at the email or physical address set out below to request deletion containing adequate details of the request (although we do not undertake to respond to, or otherwise implement, the request within any specific period of time). Please be aware that information deleted (whether directly by you or pursuant to a deletion request) may or may not be permanently deleted, and may remain stored on our servers (or those of our third party service providers) – in such cases, the information will no longer be accessible or visible to you, but will be accessible and visible to us. We, at our discretion, decide whether or not to permanently delete information from our servers.

 

13. Candidates for Employment at Apex.AI Or Our Affiliates

If you submit Personal Information to Apex.AI or one of our affiliates in conjunction with an application for employment then the Apex.AI Employment Applicant Policy applies to all Personal Information contained in your employment application. That policy may be found on our candidate application site. 

 

14. Collection of Data and Transfer Outside the United States. 

Apex.AI is a company headquartered in the United States. This site is primarily controlled and operated from the United States; however, information collected about you or your use of our products or services may be collected, stored, and processed in any country where we have facilities or in which we engage service providers. Some of these jurisdictions, including the United States, may not provide an equivalent level of data protection as your home jurisdiction.
